By engaging WHYN's services or submitting an enquiry, you agree to these terms. Please read them before proceeding.
1. Services
WHYN provides conversion system builds including landing pages, email automation sequences, and booking flows for coaches and online sellers.
The specific scope, deliverables, and timeline for each engagement are agreed upon during the discovery call and confirmed in writing before work begins.
2. No guaranteed results
We build systems optimised for conversion based on industry best practices and our experience. However, we cannot and do not guarantee specific revenue outcomes, booking numbers, or lead volumes.
Results depend on factors outside our control including your offer quality, audience size, market conditions, and your follow-through.
3. Payment
Payment terms are agreed individually for each engagement. Generally:
- A deposit (typically 50%) is required before work begins
- The remaining balance is due upon delivery
- All fees are stated in writing before work begins
- Payments are non-refundable once work has commenced, unless we fail to deliver the agreed scope
4. Intellectual property
Upon full payment, you own all deliverables we produce for you — including the landing page code, copy, and automation sequences.
We retain the right to describe the project in our portfolio and case studies (without disclosing confidential business details) unless you request otherwise in writing.
5. Your responsibilities
You are responsible for:
- Providing accurate information about your business and goals
- Timely feedback and approvals during the build process
- Ensuring your offer and claims comply with applicable advertising laws
- Maintaining the platforms and tools we integrate (Cal.com, email provider, etc.)
6. Limitation of liability
To the maximum extent permitted by law, WHYN's total liability for any claim arising from our services shall not exceed the fees paid by you in the 3 months preceding the claim.
We are not liable for indirect, consequential, or incidental losses including lost profit, lost revenue, or loss of data.
7. Confidentiality
Both parties agree to keep confidential any non-public information shared during the engagement. This obligation survives termination of the agreement.
8. Termination
Either party may terminate an engagement with 7 days written notice. Work completed up to the termination date is billable. We will deliver all completed work in its current state.
9. Governing law
These terms are governed by the laws of the jurisdiction in which WHYN is registered. Any disputes will be resolved by negotiation in good faith before any legal action is taken.
